Terms of Use

Article 1: Definitions

The following terms are used in these Terms of Use:

  • SkillsCV: SkillsCV B.V., located at Woestduinlaan 57, 3941 ZJ Doorn, KvK number 77922190
  • Platform: The SkillsCV digital resume platform and job site, accessible at www.skillscv.nl
  • User/Candidate: Natural person who registers on the SkillsCV platform
  • Profile: Digital representation of user skills, experience and availability
  • Employer: Organization that has access to anonymized profiles through The Talentpool Community
  • Matching: Automatic matching of candidate profiles to jobs based on skills
  • Active Participation: Requirement for free users to be more responsive to employer requests

Article 2: Applicability

2.1 These Terms of Use apply to all uses of the SkillsCV platform.

2.2 By registering and creating an account, the user fully and unconditionally accepts these terms and conditions.

2.3 If the user does not agree with these terms and conditions, in whole or in part, they should discontinue use of the platform.

2.4 These terms and conditions are subject to change. Users will be notified of changes via email 30 days in advance.

Article 3: Services SkillsCV

3.1 SkillsCV offers the following services:

  • Anonymous profile database for skills-based matching
  • Job display based on personal skills-match
  • Communication facilities between candidates and employers (upon mutual consent)
  • Career tools and advice
  • Free basic use under conditions of active participation

3.2 SkillsCV strives to provide the best possible service but makes no guarantees about:

  • Availability of vacancies
  • Quality of matching results
  • Successful job placement
  • Uninterrupted platform availability

Article 4: Active Participation Requirements

4.1 Availability obligation

Free use of SkillsCV includes users:

  • Keeping their profile on ‘findable’ when actively searching for employment opportunities
  • Setting their profile to ‘not findable’ when they are temporarily unavailable for new opportunities
  • Keep your profile information accurate, complete, and up to date.
  • Update their availability and preferences regularly

4.2 Response Obligation

4.2.1 Users must respond within 5 working days to:

  • Invitations from employers for interviews or contact
  • Questions regarding availability or interest
  • Requests for additional information or clarification
  • Other relevant communications via the platform

4.2.2 A valid response may include:

  • Confirmation of interest and availability
  • A polite decline with reason
  • A request for postponement or more information
  • Notification of updated availability

4.3 Inactivity Policy

4.3.1 If no response is received within 5 working days:

  • An automatic reminder email will be sent to the user
  • The employer will be informed of the delayed response

4.3.2 If no response is received within 2 weeks:

  • A second reminder email will be sent, including a warning
  • The employer will be notified of non-responsiveness

4.3.3 If no response is received within 4 weeks:

  • The user’s profile will automatically be set to “inactive”
  • The user will be notified of the inactive status
  • Reactivation is possible by logging in and confirming availability

4.4 Abuse Policy

4.4.1 SkillsCV reserves the right to take action in cases of:

  • Systematic non-responsiveness (more than 3 missed responses in 6 months)
  • Providing false or misleading profile information
  • Misuse of communication features
  • Breach of these user terms
  • Unprofessional behavior towards employers

4.4.2 Possible actions include:

  • A warning with a 7-day grace period to correct the issue
  • Temporary account suspension (30 days)
  • Permanent account ban
  • Exclusion from future use of SkillsCV services

Article 5: User Obligations

5.1 Registration and Account

5.1.1 Users must:

  • Provide truthful and complete registration details
  • Create only one account per person
  • Keep login credentials secure and confidential
  • Promptly update any changes in contact information

5.2 Profile Maintenance

5.2.1 Users are responsible for keeping their profile up to date:

  • Update skills and competencies when gaining new experience
  • Keep work history and education current
  • Adjust availability and preferences as needed
  • Remove outdated or irrelevant information

5.3 Prohibited Use

5.3.1 Users are not allowed to use the platform for:

  • Providing false, misleading, or incomplete information
  • Creating duplicate accounts
  • Sending spam or unsolicited messages
  • Violating the privacy of other users or employers
  • Engaging in illegal or unethical behavior
  • Infringing intellectual property rights
  • Disrupting the platform or its systems
  • onducting commercial activities without prior approval

Article 6: Intellectual Property

6.1 The SkillsCV platform, including all technology, software, databases, and content, is the property of SkillsCV B.V.

6.2 Users retain ownership of their profile content but grant SkillsCV a royalty-free license to:

  • Display profiles to employers (anonymized)
  • Improve matching algorithms and service quality
  • Use anonymized data for aggregated statistics and market research

6.3 Users may not copy, reproduce, or reuse any content from the platform without written permission.

Article 7: Privacy and Data Protection

7.1 Personal data is processed in accordance with the SkillsCV Privacy Policy.

7.2 Core Principles:

  • Anonymous matching: no candidate identification without explicit consent
  • Minimal data processing: only necessary data is collected
  • Secure storage: technical and organizational security measures
  • User rights: access, correction, and deletion according to GDPR

7.3 Upon account termination, users can export their data for 30 days, after which all data will be permanently deleted.

Article 8: Termination of the Account

8.1 By the User

8.1.1 Users may terminate their account immediately via:

  • Data export is available for 30 days
  • Communication with employers will cease
  • Profile will be removed from the matching system
  • Full deletion will occur after 30 days

8.2 By SkillsCV

8.2.1 SkillsCV may terminate accounts in cases of:

  • Violation of user terms
  • Inactivity exceeding 12 months
  • Technical or security issues
  • Legal obligations

8.2.2 Procedure:

  • A warning will be issued with a 7-day correction period (except in severe cases)
  • Temporary suspension for first offenses
  • Permanent ban for repeated or serious violations

Article 9: Liability

9.1 SkillsCV Liability

9.1.1 SkillsCV strives to provide reliable services but limits liability to direct damages up to €500 per incident.

9.1.2 SkillsCV is not liable for:

  • Job quality or suitability
  • Employer or user behavior
  • Matching outcomes or application results
  • Technical failures or downtime
  • Indirect damages, consequential loss, or lost profits
  • Loss of data, opportunities, or contracts

9.1.3 Exceptions to limitation:

  • Intentional or gross negligence by SkillsCV
  • Violation of privacy obligations
  • Liability not legally excludable

9.2 User Liability

9.2.1 Users are liable for damages caused by:

  • Breach of these user terms
  • Providing false or misleading information
  • Misuse of platform features
  • Infringement of third-party rights

9.2.2 Users shall indemnify SkillsCV against third-party claims related to their use of the platform.

Article 10: Force Majeure

10.1 SkillsCV is not liable for failure to fulfill obligations due to force majeure.

10.2 This includes: natural disasters, pandemics, cyberattacks, government actions, strikes, supplier failures, and other circumstances beyond reasonable control.

Article 11: Modifications

11.1 SkillsCV may update these terms to comply with:

  • Legal requirements
  • Technological developments
  • Service improvements

11.2 Changes will be communicated 30 days in advance via email and platform notifications.

11.3 Continued use after the effective date constitutes acceptance of the changes.

11.4 If the user does not accept the changes, they may terminate the account without charge.

Article 12: Dispute Resolution

12.1 These terms are governed by Dutch law.

12.2 Disputes should be resolved through mediation before legal proceedings.

12.3 Unless otherwise mandated by law, disputes fall under the exclusive jurisdiction of the District Court of Midden-Nederland (Utrecht).

Article 13: Final Provisions

13.1 If any clause is invalid or unenforceable, the remaining provisions remain in effect.

13.2 In unregulated cases, SkillsCV will act in fairness and reasonableness.

13.3 SkillsCV may transfer its rights and obligations to third parties with written notice to users.
