  • The Talentpool Community (TPC): <\/b>The digital platform operated by SkillsCV B.V. for employers, accessible via www.cloudways-thetalentpoolcommunity.admin-developer.com<\/span><\/li>
  • SkillsCV B.V.:<\/b> A private company registered at Woestduinlaan 57, 3941 ZJ Doorn, Chamber of Commerce No. 77922190<\/span><\/li>
  • User\/Employer:<\/b> A legal entity or natural person who registers on TPC for recruitment and selection purposes<\/span><\/li>
  • Candidate: <\/b>A user of the SkillsCV platform whose anonymized profile is available for matching<\/span><\/li>
  • Matching: <\/b>AI-powered linking of candidate profiles to job requirements based on skills<\/span><\/li>
  • Credit:<\/b> A unit in the credits system used for initiating contact with candidates<\/span><\/li>
  • Subscription: <\/b>Monthly access to TPC services at a fixed rate<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    The Talentpool Community is a digital platform that helps employers and public institutions connect with job seekers through fair and efficient skill-based matching. The platform promotes equal opportunity in the labor market through anonymized profiles and data-driven matching. <\/p>

    2.2 Market Innovation<\/strong><\/p>

    TPC addresses current labor market challenges such as:<\/p>

    • Inefficient matching between job supply and demand<\/li>
    • Discrimination based on name, age, or origin<\/li>
    • Waste of recruitment resources<\/li>
    • Lack of transparency in the hiring process<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

      4.1.1 TPC uses AI technology to:<\/p>

      • Optimize search results<\/li><\/ul>

        4.1.2 The matching algorithm considers:<\/p>

        • Skills and competencies<\/li>
        • Experience and education level<\/li>
        • Availability and preferences<\/li>
        • Location and commuting distance (if relevant)<\/li><\/ul>

          4.2 AI Transparency (per EU AI Act)<\/strong><\/p>

          4.2.1 Risk Classification:<\/b><\/strong> Limited risk under Article 52 of the EU AI Act<\/p>

          4.2.2 Transparency Obligations:<\/b><\/strong><\/p>

          • General matching criteria are available upon request<\/li>
          • Users are informed about the use of AI systems<\/li>
          • Significant algorithm changes will be communicated<\/li>
          • Bias monitoring and fairness audits are conducted regularly<\/li><\/ul>

            4.2.3 Human Oversight:<\/b><\/strong><\/p>

            • Final candidate selection remains a human decision<\/li>
            • Employers can review and adjust matching results<\/li>
            • No fully automated decisions with legal consequences are made<\/li><\/ul>

              4.3 Limitations<\/strong><\/p>

              4.3.1 TPC does not guarantee:<\/p>

              • Complete or perfect accuracy of matches<\/li>
              • Availability of suitable candidates<\/li>
              • Candidate responses to contact requests<\/li>

                  • Send invitations to candidates of interest<\/li>
                  • Messaging system for initial communication<\/li>

                    5.3 Analytics and Reporting<\/strong><\/p>

                    • Matching statistics and performance indicators<\/li>
                    • Recruitment dashboards and trend insights<\/li>
                    • Market insights and benchmarking tools<\/li><\/ul>

                      5.4 Prohibited Use Users may NOT use the platform for:<\/strong><\/p>

                      • Disrupting platform functionalities<\/li>
                      • Violating candidate privacy<\/li>
                      • Illegal or unethical purposes<\/li>

                          • 1 credit per candidate referred by the employer and successfully registered on SkillsCV<\/li>
                          • Bonus credits for active network expansion<\/li>
                          • Promotional credits during campaigns<\/li><\/ul>

                            6.2.2 Using Credits:<\/b><\/strong><\/p>

                            • 1 credit for contacting a candidate after positive response<\/li>
                            • Credits may be required for accessing full profiles<\/li>
                            • Premium features may carry variable credit costs<\/li><\/ul>

                              6.2.3 Fair Use Policy<\/b><\/strong>: Reasonable use applies. Excessive usage may result in additional charges or restrictions. <\/p>

                              6.3 Future Developments<\/strong><\/p>

                                    8.2.1 Monthly termination with one (1) month notice<\/p>

                                    8.2.2 Cancellation via:<\/p>

                                    • Account settings on the platform<\/li>
                                    • Written notice to info@skillscv.nl<\/li>
                                    • Phone (with written confirmation)<\/li><\/ul>

                                      8.3 Termination by TPC<\/strong><\/p>

                                      8.3.1 Grounds include:<\/p>

                                      • Non-payment (after 60 days)<\/li>
                                      • Serious violations of terms<\/li>
                                      • Abuse of platform or services<\/li>
                                      • Bankruptcy or suspension of payment<\/li><\/ul>

                                        8.3.2 For minor violations, a 14-day remedy period applies<\/p>

                                        8.4 Data Handling After Termination<\/strong><\/p>

                                        8.4.1 Immediately upon termination:<\/b><\/strong><\/p>

                                        • Platform access revoked<\/li>
                                        • Active matches discontinued<\/li>
                                        • New contact requests blocked<\/li><\/ul>

                                          8.4.2 Within 30 days:<\/b><\/strong><\/p>

                                          • User data deleted (subject to legal retention)<\/li>
                                          • Data export available upon request<\/li>
                                          • Communication logs archived<\/li><\/ul>

                                            8.4.3 Exceptions<\/b><\/strong>:<\/p>

                                              All rights to the platform, technology, content and data processing belong to SkillsCV B.V.<\/p>

                                              Employers receive a non-exclusive, non-transferable licence for use during the contract period.<\/p>

                                              Use other than for the intended recruitment purpose is not allowed without written permission.<\/p>

                                              9.4 Vacature-content<\/b><\/strong> <\/p>

                                              10.1 Limited Liability of TPC<\/b><\/strong><\/p>

                                              10.1.1 TPC aims to provide reliable services. Liability is limited to the total subscription fees paid in the three (3) months preceding the incident.<\/p>

                                              10.2 Excluded Liability<\/b><\/strong><\/p>

                                              TPC is not liable for:<\/p>

                                              • Candidate quality, suitability, or availability<\/li>
                                              • Accuracy of matching results<\/li>
                                              • Candidate behavior or performance<\/li>
                                              • Successful hiring or placement<\/li>
                                              • Third-party technical issues<\/li>
                                              • Indirect or consequential damages<\/li>
                                              • Loss of data, contracts, or opportunities<\/li>
                                              • Unauthorized account use<\/li><\/ul>

                                                10.3 Force Majeure<\/b><\/strong><\/p>

                                                10.3.1 TPC is not liable for:<\/p>

                                                • Natural disasters, extreme weather<\/li>
                                                • Pandemics and government restrictions<\/li>
                                                • Cyberattacks and system outages<\/li>
                                                • Strikes or labor disputes<\/li>
                                                • Supplier failures<\/li>
                                                • Other events beyond reasonable control<\/li><\/ul>

                                                  10.4 User Indemnity<\/b><\/strong><\/p>

                                                  10.4.1 Users indemnify TPC from third-party claims arising from:<\/p>

                                                  • Violations of these terms<\/li>
                                                  • Discriminatory recruitment practices<\/li>
                                                  • Infringing intellectual property rights<\/li>
                                                  • Labor law violations<\/li>
                                                  • Unlawful treatment of candidates<\/li><\/ul>

                                                        • Respect candidate anonymity<\/li>
                                                        • Comply with anti-discrimination laws<\/li>
                                                        • Handle candidate data with care<\/li>

                                                            • Users will be informed at least 30 days in advance<\/li>
                                                            • Notice via email and platform notifications<\/li>
                                                            • Major changes will be explained clearly<\/li><\/ul>

                                                              12.3 Acceptance:<\/strong><\/p>

                                                              • Continued use after effective date constitutes acceptance<\/li>
                                                              • Users may cancel at no cost within 30 days if they object<\/li>

                                                                13.3 The competent court<\/b><\/strong> is the District Court of Midden-Nederland (Utrecht), unless otherwise required by law.<\/p>

                                                                13.4 Disputes<\/b><\/strong> under \u20ac5,000 may be submitted to the district court in the user\u2019s place of residence.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t
